These Terms of Service ("Terms") govern your access to and use of Heartuned (the "Service"). By creating an account, starting a trial, or purchasing a membership or product, you agree to these Terms. If you do not agree, please do not use the Service.

Heartuned is a trading name of Aya Caps LLC, a limited liability company registered in Delaware, United States, at 8 The Green, STE B, Dover, DE 19901, United States. "We", "us" and "our" refer to Aya Caps LLC, which is the company you contract with and which appears on your payment records. Charges show on your statement as HEARTUNED.

Heartuned provides educational, wellness, and community content to help parents and caregivers practise co-regulation with their children.

The Service is not a medical, psychological, diagnostic, crisis, or emergency service, and it does not provide professional advice. It does not replace care from a qualified professional or your own judgment as a parent. If you have a medical or safety concern, contact a qualified professional or your local emergency services.

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for parents and caregivers, not for use by children.

You are responsible for the information you provide, for keeping your login credentials secure, and for activity that occurs under your account.

Our core program is sold as a one-time purchase with lifetime access, at the price shown at checkout. Promotional pricing may vary.

Membership is an optional add-on offered to program customers, billed yearly or monthly at the prices shown at checkout. Limited-time free trials may occasionally be offered; if you do not cancel before a trial ends, your membership begins automatically and the applicable fee is charged.

Memberships renew automatically until cancelled. You can cancel or pause at any time from your account; cancellation stops future renewals and access continues through the end of the paid period. Prices may change with notice; changes apply to future billing periods.

Some content is offered as one-time purchases. These grant the access described at checkout and are governed by the Refund Policy.

Be kind and respectful in the community. Do not post unlawful, harmful, harassing, or infringing content, spam, or another person's private information, and do not attempt to disrupt or gain unauthorised access to the Service.

We may moderate, remove content, or suspend accounts that violate these Terms.

All content provided through the Service is owned by Heartuned or its licensors and is provided for your personal, non-commercial use. You may not copy, redistribute, resell, or publicly share it without permission.

The AI co-regulation tool offers educational suggestions grounded in approved content. It is subject to the AI Wellness Disclaimer, which forms part of these Terms.

If you participate in our affiliate program, additional affiliate terms apply. Affiliates are independent and are solely responsible for reporting and paying any taxes on commissions they earn.

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

To the maximum extent permitted by law, Heartuned will not be liable for any indirect, incidental, or consequential damages, and our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

We may update these Terms from time to time; material changes will be communicated, and continued use means you accept the updated Terms. We may suspend or terminate access for violations of these Terms.
